As reported in The Ledger Enquirer: On February 3rd a homeless man with HIV is accused of raping a woman near the Chattahoochee River.
Joseph Lee Sims, age 55, pleaded not guilty to rape, sodomy, Reckless Conduct HIV and giving false information to police.
I am not here to give you my opinion as to whether or not Mr. Sims is innocent or guilty. I am here to say that anyone who is knowingly HIV-positive and commits the atrocity of rape should be sentenced under the guidelines of attempted murder.
In America every 98 seconds someone is sexually assaulted. Make no mistake, it is a violent crime. Though many victims escape with their lives a large number of them wish they had not. 33% of women who are raped contemplate suicide 13% of them actually attempt it. www.rainn.org
It is not a matter of adding insult to injury when a rapist has HIV, it is a matter of imposing on the victim a death sentence. The human body can not get rid of HIV. Once you have it, you have it for life. Instead of a quick bullet to the brain or a fatal stab wound, they are imposing on their victim a slow, painful, horrific death. The weapon may be different, but the result is the same.
I often hear about how our laws have to catch up with technology. I think our laws also need to catch up with reality. If my wife had her way, anyone found guilty of rape and convicted on indisputable DNA evidence would be castrated. She considers it taking away a criminal’s weapon of choice. I won’t bother to tell you what she wants to do with an HIV-positive rapist – just hearing it you wouldn’t be able to sit down for a week. Maybe we need more female judges (as long as they’re all Southern redneck women).
